California man gets 6 years for foiled murder plot (AP)
LOS ANGELES ? If Eugene Temkin had heeded a warning by FBI agents two years ago to not kill a former business partner, he wouldn't have found himself in front of a judge on Monday, being sentenced to six years in prison for hatching a murder-for-hire plot.
The 51-year-old man from Goleta, Calif., tried twice to carry out the hit on Michael Hershman, with the second attempt just four months after the FBI learned about the diabolical plan and warned him to stay away. In both instances, Temkin unwittingly tried to hire an undercover law enforcement officer to carry out the hit.
He was convicted last year of three murder-for-hire-related counts. Federal prosecutors sought a 20-year prison sentence, but U.S. District Judge Stephen Wilson noted Temkin had no prior criminal record. He also noted that Temkin contemplated the hit on Hershman for more than six years but never followed through, seeming intent during some instances and in others "just blowing steam."
In the end, however, Temkin "was walking a tightrope, a thin line and he went over that line," Wilson said.
Temkin, shackled in handcuffs, asked for forgiveness during the hearing but never directly mentioned Hershman, who sat only a few feet away.
"I seek forgiveness from those who were adversely affected by my actions," said Temkin, who on several occasions looked in Hershman's direction.
The case was striking because of Temkin's desire to destroy Hershman for a business deal that soured nearly a decade earlier. Court documents showed the fear, helplessness and frustration of Hershman and his family, who said they were terrorized and traumatized while getting little help from authorities.
For Hershman and his family, the last several years have been painful and agonizing. His 20-year-old son died from an accidental drug overdose in late 2010, and he slept with a machete because Temkin hired people to stalk and harass him, Hershman said. His college-age daughter has been placed in a psychiatric clinic in Texas where she has hallucinations and believes she's been kidnapped by Temkin, he said.
"The relentless problems and things Mr. Temkin has inflicted, I wouldn't wish it upon anyone in this room, not even on Mr. Temkin himself," Hershman said.
The men met when they were selling drugs in the 1980s, according to court documents. In 2001, Temkin lent Hershman $500,000 ? money from a second mortgage on an apartment building he owned ? to invest in a casino in Equatorial Guinea. When Hershman was unable to repay Temkin right away because the casino had not fared well, Temkin sued his then-business partner after losing the apartment complex in foreclosure.
The lawsuit was settled in 2006, but authorities said Temkin wanted about $5 million for unrealized profits he would have received had he sold the apartment building before the real estate market crashed.
Temkin repeatedly threatened and harassed Hershman and his family, investigators said. Pictures and other heirlooms were stolen from Hershman's storage unit. Their emails were hacked, and his children said they were followed by strange men.
Temkin was never charged in connection with those incidents, but Hershman obtained a restraining order against him in 2007, saying Temkin made gun signals at him with his hands, according to an affidavit.
Hershman said he pleaded with law enforcement agencies to investigate Temkin but they did nothing.
The investigation took a turn in late 2009 when one of Temkin's friends approached Los Angeles County sheriff's detectives saying Temkin wanted to extort money from Hershman before killing him. A series of meetings were arranged between an undercover detective posing as a hit man and Temkin, who gave varying scenarios of how Hershman should be killed.
One plot involved a crew kidnapping Hershman and his family in the Dominican Republic and having the undercover officer kill them.
"Hang him from a door, throw him from a fishing boat, all works for me," Temkin said during one of the recorded conversations with the investigator.
In March 2010, FBI agents met with Temkin who told them about the dispute but denied making threats. The agents then told Temkin not to threaten, hurt or kill Hershman, according to court documents. Temkin agreed.
FBI spokeswoman Laura Eimiller said it's not uncommon for law enforcement agencies to receive cases where death threats are made, but "the government has to prove a legal intent that someone planned to go through with it."
Temkin apparently wasn't dissuaded, because several months later authorities learned he was still interested in killing Hershman. Another undercover officer, acting as a hit man, began meeting with Temkin, who indicated he had another hired hand to kill Hershman but would call the officer if plans fell through.
In July 2010, Temkin gave the officer the green light to kill Hershman, his wife and a business partner, authorities said. Temkin provided the undercover officer with Hershman's passport number, photographs of the would-be victims and 30 $100 bills for the job expected to cost $30,000.
Temkin was arrested six days later at his home outside of Santa Barbara.
In arguing for a sentence no greater than six years, defense attorney Richard Callahan said Temkin called off plans to kill Hershman after the meeting with FBI agents.
"While Mr. Temkin was angry and fixated on Hershman's debt, he never took action on it for almost 10 years despite clear opportunities to do so," Callahan wrote. It wasn't until the FBI intervened that Temkin "crossed the line."
Wilson said he's unsure if Temkin truly wanted to follow through on his plans.
"No one knows exactly what was in his mind," he said.

Stacey Irvine, 17, has reportedly survived on her nugget-heavy diet, occasionally supplemented by a bag of chips or piece of toast, since she was a toddler. Doctors have urgerd her to change her ways, but Irvine's case got us wondering: what would actually happen if you ate only one type of food for your entire life?
Depends on the poison you pick, but poison it most likely would be. According to Jo Ann Hattner, a nutrition consultant at Stanford University School of Medicine and former national spokesperson for the American Dietetic Association, choosing to eat only one fruit, vegetable or grain would lead to organ failure. Consuming only meat would eventually force your body to start munching on?your own muscles. And if you stuck solely to almost any one food (besides fruit), you would develop a serious case of scurvy.
"I wouldn't recommend this experiment," said Hattner, who also wrote "Gut Insight" (Hattner Nutrition, 2009), a book about digestive health.
No single vegetable or legume has all nine essential amino acids humans need to build the proteins that make up our muscles, Hattner said. That's why most human cultures, without knowing anything about food chemistry, have developed diets centered on complementary veggies that, together, provide all nine. At first, without all the right amino acids, your hair starts to lighten in color and your fingernails get soft. Much worse, "your lean body mass suffers. That doesn't just mean your muscles, but also your heart and your organs." Eventually, your heart shrinks so much you die; this happens, on occasion, with extreme cases of?anorexia nervosa.
Eating only one type of carbohydrate ? just bread or pasta, for example ? also causes organ failure, due to amino acid deficiency. On top of that, you'd get scurvy, a horrific disease brought on by lack of vitamin C, an essential component of many of the body's chemical reactions. Thanks to?highly unethical experiments?carried out on prison inmates in Britain and the United States in the 1940s, we know that scurvy hits after one to eight months of vitamin C deprivation (depending on the quantity one's body has stored to begin with). At first, you feel lethargic and your bones ache. Later, strange spots pop up all over your body and develop into suppurating wounds. You get jaundice, fever, tooth loss and, eventually, you die. Life as a "meat purist" would also be a dead-end.
In addition to lacking vitamin C, most meats contain very few carbs ? the easy-to-access packets of energy your body constantly requires to perform even the smallest tasks. "Without carbohydrates, you're going to start to break down some of your muscle mass to get the energy," Hattner said. Again, "muscle" doesn't just mean your biceps. You'll be eating your own heart, too.
However, there is one food that has it all: the one that keeps babies alive. "The only food that provides all the nutrients that humans need is human milk," Hattner said. "Mother's milk is a complete food. We may add some solid foods to an infant's diet in the first year of life to provide more iron and other nutrients, but there is a little bit of everything in human milk."
Technically, adults could survive on?human milk, too, she said; the sticking point would be finding a woman who is willing to provide it (and enough of it). Lacking that option, the second-best choice would be mammalian milk, especially if it is fermented. "Yogurt, which is fermented milk, has a lot of bacteria that is good for the digestive tract," Hattner said.
These hypothetical scenarios aren't just whimsical speculation. In many parts of the world, people have no choice but to eat mostly one food: often, rice. Scientists are developing genetically modified rice that contains more vitamins and nutrients, especially vitamin A, in order to fight malnutrition.
Figuring out how to pack everything we need into one food is also useful for space travel, Hattner said. "The impetus of a lot of nutritional science is, 'How do we feed?people in space?' Scientists are trying to increase the nutritional concentration of food so you don't have a lot of bulk."

EU rejects call for control over Greek budget (AP)
BRUSSELS ? The European Union's executive body is rejecting calls from Germany to establish a eurozone budget commissioner who would directly control tax and spending decisions in debt-ridden Greece.
The European Commission said Saturday that "executive tasks must remain the full responsibility of the Greek government, which is accountable before its citizens and its institutions."
The Commission, the European Central Bank, and the International Monetary Fund already have unprecedented powers over Greek spending, after negotiating with Athens stringent austerity measures and economic reforms in return for a first, multi-billion euro bailout.
They are reviewing implementation of these measures and discussing a second bailout.

Israel says Iran 'drifting' toward nuke goal line (AP)
DAVOS, Switzerland ? Israeli Defense Minister Ehud Barak said Friday the world must quickly stop Iran from reaching the point where even a "surgical" military strike could not block it from obtaining nuclear weapons.
Amid fears that Israel is nearing a decision to attack Iran's nuclear program, Barak said tougher international sanctions are needed against Tehran's oil and banks so that "we all will know early enough whether the Iranians are ready to give up their nuclear weapons program."
Iran insists its atomic program is only aimed at producing energy and research, but has repeatedly refused to consider giving up its ability to enrich uranium.
"We are determined to prevent Iran from turning nuclear. And even the American president and opinion leaders have said that no option should be removed from the table and Iran should be blocked from turning nuclear," Barak told reporters during the annual meeting of the World Economic Forum.
"It seems to us to be urgent, because the Iranians are deliberately drifting into what we call an immunity zone where practically no surgical operation could block them," he said.
Barak called it "a challenge for the whole world" to prevent a nuclear-armed Iran but stopped short of confirming any action that could further stoke Washington's concern about a possible Israeli military strike.
Separately, U.N. Secretary General Ban Ki-Moon urged a resumption of dialogue between Western powers and Iran on their nuclear dispute.
He said Friday that Tehran must comply with Security Council resolutions and prove conclusively that its nuclear development program is not directed to making arms.
"The onus is on Iran," said Ban, speaking at a press conference. "They have to prove themselves that their nuclear development program is genuinely for peaceful purposes, which they have not done yet."
Ban expressed concern at the most recent report of the International Atomic Energy Agency that strongly suggested that Iran's nuclear program, which it long has claimed is for development of power generation, has a military intent.
IAEA chief Yukiya Amano said at a Davos session that "we do not have that much confidence if Iran has declared everything" and its best information "indicates that Iran has engaged in activities relevant to nuclear explosive devices."
"For now they do not have the capacity to manufacture the fuel," he said. "But in the future, we don't know."
In spite of his tough words to Iran, Ban said that dialogue among the "three-plus-three" ? Germany, France and Britain plus Russia, China and the United States ? is the path forward.
"There is no other alternative for addressing this crisis than peaceful ... resolution through dialogue," said Ban.
Ban noted that there have been a total of five Security Council resolutions so far on the Iranian nuclear program, four calling for sanctions.
As tensions have been on the rise recently, some political leaders in Israel and the United States have been speaking increasingly of the possibility of a military strike to eliminate, or at least slow down, what they allege is a determined effort by Iran to obtain nuclear weapons.

NC Democratic Gov. Perdue won't seek re-election (AP)
RALEIGH, N.C. ? Democratic North Carolina Gov. Beverly Perdue, the first woman elected governor in the state, said Thursday she would not seek re-election this year because she believes a bid would make it more difficult to fund education.
Perdue has faced poor poll numbers, continued budget troubles and a campaign investigation while Republicans took over the Legislature last year.
She announced last week she would offer a budget this spring that would seek a sales tax increase for education. Republicans let a temporary sales tax increase expire last summer, and at least one legislative leader called her proposal dead on arrival.
"We live in highly partisan times, where some people seem more worried about scoring political points than working together to address the real challenges our state faces," Perdue said in an email to supporters. A re-election bid, she added, "will only further politicize the fight to adequately fund our schools."
Perdue faced a tough rematch against former Charlotte Mayor Pat McCrory, a Republican she narrowly defeated in 2008 in the state's closest gubernatorial contest since 1972. Perdue's win was partly attributed to Barack Obama's surprise victory in North Carolina ? the first in 36 years for a Democratic nominee for president.
News of Perdue's decision came as North Carolina Democratic Rep. Brad Miller said he also would not seek re-election, avoiding a potential primary contest against fellow Democrat David Price after the Republican-controlled Legislature drew them into the same district.
North Carolina is considered an important state for Obama's re-election prospects and Democrats decided to hold the party convention in Charlotte in September.
Perdue, 65, has struggled with a state economy hit hard by the recession and an unemployment rate persistently above the national average. Polling conducted throughout her term has consistently shown her approval ratings hovering around 40 percent.
She's had to deal with state budget problems that led her and fellow Democrats to raise the sales tax by a penny in 2009 and make deep cuts to education and health care. The first-term governor more recently clashed with the new Republican leadership in the General Assembly, which swept into power after the 2010 elections and gave GOP control of the Legislature for the first time since the 1870s.
Perdue has traded jabs with Republican leaders on issues ranging from jobless benefits to a measure allowing death row inmates to use statistical evidence of racial bias to challenge their convictions. In a sign of the tension, she vetoed a record 16 bills last year.
She faced scrutiny about her 2008 campaign and more than three dozen flights that she didn't initially report on campaign filings required by state election officials. A local prosecutor has said the governor wasn't the focus of his investigation, but four people have been indicted related to the flight investigation, including her former campaign finance director.
Perdue had said for months she was running again, and she raised more than $2.6 million in 2011. The amount was only slightly more than what McCrory had raised during last year ? a poor showing in a state where Democratic candidates routinely outspend Republicans in statewide elections. Perdue's term goes through the end of the year.
"To those of you who have supported me throughout my years of public service, I will always be grateful for the confidence you have placed in me," Perdue said. "In my remaining months in office, I look forward to continuing to fight for the priorities we share, by putting North Carolinians back to work and investing in our children's future."
Democratic state Rep. Bill Faison, who has been hinting he wanted to run for governor, said he was not surprised Perdue is stepping aside. For weeks, prominent people in the party worried about Perdue's low poll numbers had been visiting the governor and suggesting she not run, Faison said.
"I don't think anyone will be surprised by what that announcement is," Faison said.
Lt. Gov. Walter Dalton, another Democrat, would seem to consider a run. Democratic Attorney General Roy Cooper, who toyed with a gubernatorial bid in 2008 but decided against the idea, announced Thursday he would run for a fourth term as the state's top law enforcement officer.
A native of Virginia, Perdue worked as a teacher and moved in the 1970s to the coastal town of New Bern, where she became director of geriatric services at a hospital before entering politics. She served in the Legislature and as lieutenant governor before being elected governor.

For the novice investor having even a cursory understanding of how and why capital flows is necessary to making the best investment choices. If you do not believe your time is well spent doing that and have the means, then seeking the advice of the professional financial planner to guide your investments is not only a choice but is recommended.

Mayor blasted for 'taco' comment amid bias probe
HARTFORD, Conn. (AP) ? In a world of polished politicians, East Haven Mayor Joseph Maturo Jr.'s tendency to speak his mind without hesitation or much self-censorship has earned him loyal friends and vehement foes over the decades in his suburban Connecticut hometown.
But now, it's also earned him a place in the national spotlight as the mayor who, after four of his police officers were arrested Tuesday for alleged anti-Latino bias, said he "might have tacos" as a way of doing something for those minorities.
Maturo has since apologized for the remark, which he made during a taped interview at his office with a New York television station and which spread through cyberspace at blistering speed.
It came in response to a reporter's question about the FBI's arrest of the four officers in this shoreline town, which has been under federal scrutiny since the U.S. Department of Justice launched a civil rights probe in 2009 that found a pattern of discrimination and biased policing.
The town's Democratic Party is now demanding the resignation of Maturo, a Republican, and he's fielded criticism from Connecticut Gov. Dannel P. Malloy, U.S. Rep. Christopher Murphy and other state and local officials.
The video of Maturo's comments quickly spread on Facebook pages, Twitter accounts and on media outlet sites late Tuesday and throughout Wednesday. They also prompted Connecticut's largest paper, The Hartford Courant, to call for his resignation in an editorial that declared: "The Mayor is an Idiot."
Those who've known Maturo say he's not an idiot or a bigot, but that if the taco comment was meant to be a joke, it was clearly a misstep they think he genuinely regrets.
"He's a very regular sort of person, very generous, very loyal, and I know he cares very deeply about all of the people that the represents," said Christopher Healy, a former Connecticut state Republican party chairman.
"This is not at all to underestimate how serious these words were and how hurtful they were to many people, but I do know he takes his job seriously and cares deeply about the community," Healy said.
But Marcia Chacon, a store owner in East Haven, said she and other Latinos took offense at the mayor's "taco" comment.
"This is an insult against us," Chacon said. "I thought 'Wow, here we are in East Haven, and this is the person who is supposed to help us.'"
Maturo asked East Haven residents in a written apology Wednesday to "have faith in me" and the town as it faces the discrimination allegations, in which the four officers are accused of engaging in patterns of harassment and intimidation against Latinos, who make up 10 percent of the approximately 28,000 people in the blue-collar town.
Maturo, 60, is an East Haven native through and through. He attended local schools and colleges, became an electrician and electrical inspector, and served in the U.S. Navy during the Vietnam War before returning to his hometown to become a firefighter.
A back injury forced him to leave that job, but he'd developed a bug for politics and served as a legislative clerk for Republicans in the Connecticut General Assembly and won a spot on East Haven's town council in 1993.
He became mayor in 1997 and was re-elected every two years until Democrat April Capone defeated him by 25 votes in 2007.
When he defeated Capone by 34 votes to reclaim the seat last fall, he reinstated the police chief she had suspended amid the federal discrimination probe, and he rebuffed the bias allegations with strong words of support for East Haven's officers.
This week's "taco" quip wasn't the first time that Maturo's tendency to speak and act without much self-censoring has landed him in trouble, though previous scrapes usually only made local headlines.
In 2004, for instance, the mayor ? known by friends to be particularly handy ? became concerned that one of the town grates was an immediate hazard, so he hopped down into a sewer hole and removed it himself.
He also installed corner edges in his office and helped a worker install light switches in the library, earning a grievance against him from union members who said he was usurping their work with his impromptu repairs.
"Pretty cheesy," he said at the time of the grievance, though they've since made peace.
Whether Maturo can make peace soon with Latino residents upset by his "taco" comment remains to be seen.
Messages left for several of his political allies at the state and local levels were not immediately returned Wednesday, and East Haven's Republican Party chairman was mulling whether he intended to comment publicly.
In addition to issuing his written apology, Maturo talked Wednesday with hosts of a local radio show on which he frequently appears. Otherwise, he has said he would no longer publicly discuss the quip, which he called a "dumb, off the cuff, stupid comment" as he grew increasingly tired Tuesday after 14 interviews.
"In all that time, I made one mistake ? and it's gone viral," he told the hosts of WPLR's "Chaz & AJ in the Morning" show.
It came after WPIX-TV reporter Mario Diaz asked Maturo during an interview Tuesday, "What are you doing for the Latino community today?"
Maturo's response: "I might have tacos when I go home; I'm not quite sure yet."
Diaz then said, "You realize that's not really the comment to say right now, you 'might have tacos tonight'?"
Maturo, who is of Italian heritage, then said he might have spaghetti or any other kind of ethnic food, growing increasingly angry as he told Diaz to "go for it, take your best shot" to make the "taco" comment seem to imply something he did not intend.
Others said it was hard to interpret the comment as anything but a stereotypical jab.
"It goes to the root of the racial profiling allegations here in East Haven," said city Democratic Town Committee Chairman Gene Ruocco. "Everyone knows the seriousness of this matter and for him, as the leader of our community, to say something so utterly insensitive is a complete disgrace. He should be ashamed of himself."

WASHINGTON ? President Barack Obama has resorted to "extremism" with stifling, anti-growth policies and sought to divide Americans, not unite them, Indiana Gov. Mitch Daniels said Tuesday in the formal Republican response to the president's State of the Union address.
Eight months after deciding against a bid for his party's presidential nomination, Daniels used his nationally televised speech to lash out at Obama and cast the GOP as compassionate and eager to unchain the country's economic potential.
He took particular aim at Obama's efforts to raise taxes on the rich and castigate them for not contributing their fair share to the nation's burdens. Joined by Republicans on Capitol Hill and the presidential campaign trails, the GOP goal was to both blunt and shift the focus away from Obama's theme on Tuesday of fairness, which included protecting the middle class and making sure the rich pay an equitable share of taxes.
"No feature of the Obama presidency has been sadder than its constant effort to divide us, to curry favor with some Americans by castigating others," Daniels said, speaking from Indianapolis. "As in previous moments of national danger, we Americans are all in the same boat."
"This election is going to be a referendum on the president's economic policies," which have worsened the economy, said House Speaker John Boehner, R-Ohio. "The politics of envy, the politics of dividing our country is not what America is all about."
Also drawing frequent GOP attacks were Obama's proposed tax increases, which included making sure millionaire earners pay at least a 30 percent tax rate.
House Ways and Means Committee Chairman Dave Camp, R-Mich., said Obama's proposals to boost taxes on the wealthy and give tax breaks for domestic U.S. manufacturers and others were "nothing more than the usual Washington game that has led to a tax code already littered with lobbyist loopholes."
Daniels is a rarity in the GOP these days ? a uniting and widely respected figure, contrasting with the divisiveness emanating from the contest for the presidential nomination being waged among former Massachusetts Gov. Mitt Romney, former House Speaker Newt Gingrich and others.
President George W. Bush's first budget chief and a two-term Indiana governor, Daniels often rails against wasteful spending big budget deficits, though critics note he served during the abrupt shift from fleeting federal surpluses to massive deficits early in Bush's term.
"When President Obama claims that the state of our union is anything but grave, he must know in his heart that this is not true," Daniels said. He added that while Obama did not cause the country's economic and budget problems, "He was elected on a promise to fix them, and he cannot claim that the last three years have made things anything but worse."
The night's rhetoric come at the dawn of a presidential and congressional election year in which the defining issues are the faltering economy and weak job market and the parties' clashing prescriptions for restoring both. Obama and congressional Democrats have focused on the more populist pathway of financing federal initiatives by taxing millionaires, while Republicans preach the virtues of less regulation and smaller government.
Senate Minority Leader Mitch McConnell, R-Ky., called Obama's address "a campaign speech designed to please his liberal base," and warned that he should keep legislation advancing his priorities "free from poison pills like tax hikes on job creators."
Rep. Jim Jordan, R-Ohio, who heads large group of House conservatives, said Obama's speech was riddled with "the ridiculous idea that America isn't fair because successful people get to keep too much of the money they earn."
Republicans fired back at Obama's vision of "an economy built to last," saying it was their party that understood the best way to trigger economic growth was to get the government out of the way.
"The extremism that stifles the development of homegrown energy, or cancels a perfectly sane pipeline that would employ tens of thousands, or jacks up consumer utility bills for no improvement in either human health or world temperature, is a pro-poverty policy," Daniels said.
Obama has halted, for now, work on the proposed Keystone XL oil pipeline from western Canada to Texas' Gulf Coast. Republicans say the project would create thousands of jobs, a claim opponents say is overstated. The administration has also pursued policies aimed at reducing pollution and global warming.
To underscore Obama's decision on Keystone, Boehner invited three officials from companies he said would be hurt by the pipeline's rejection to watch the speech in the House chamber, along with a pro-pipeline legislator from Nebraska, through which the project would pass.
Obama was delivering his address during a rowdy battle for the GOP presidential nomination that has ended up providing ammunition for Obama's theme of fairness.
That fight has called attention to the wealth of one of the top contenders, Romney, and the low ? but legal ? effective federal income tax rate of around 15 percent that the multimillionaire has paid in the past two years. Romney, in Florida campaigning for that state's Jan. 31 primary, released his tax documents for the two-year period on Tuesday.
"The president's agenda sounds less like `built to last' and more like doomed to fail," Romney said in Tampa, Fla. "What he's proposing is more of the same: more taxes, more spending, and more regulation."
Romney's chief rival at this point, Gingrich, said in a written statement that the top question about Obama's speech was whether he "will show a willingness to put aside the extremist ideology of the far left and call for a new set of policies that could lead to dramatic private sector job creation and economic growth."

'UFO video' from L.A. throws up red flags
Friday the 13th ended up being a very lucky day for a California man who videoed several UFOs flying near Los Angeles. The video, allegedly shot by a freelance photographer going by the name Nerdumb, shows several bright lights in the sky over Hermosa Beach that disappear as a helicopter crosses below them. It was posted to YouTube and is making the rounds in UFO circles.
Many people noted that the lights look very much like planes taking off from Los Angeles International Airport, a few miles north of Hermosa Beach. Could they simply be aircraft? Probably not, because the lights seem to be stationary, and there's no reason commercial airplanes would suddenly switch off their lights in that pattern.
Tracey Parece, a writer for Examiner.com, wrote, "The video shows six bright lights suspended across the sky at sunset in an almost perfect straight line. The unidentified flying objects were so bright that they are very easy to spot in the video. ... A close-up of one of the objects shows a UFO that emanated red rays of light from its body." Parece concluded that Nerdumb's video "looks very convincing."
While some seem convinced the video may represent the best evidence of UFOs in 2012, others smell a hoax. For someone who claims to be a professional photographer the videos are very poorly shot and composed. Nerdumb holds the camera unsteadily, and amateurishly zooms in and out. The camera movements are very suspicious, especially the way he pans left to right as the UFO lights go out one by one, also from left to right. Instead of holding the frame steady to see if the lights reappear, he just keeps panning right for no particular reason ? almost like he knows exactly what's going to happen.
Another red flag is that the anonymous photographer is a "repeater" ? someone who has made multiple UFO reports. In fact, his YouTube channel has several other similar videos featuring a series of approximately equidistant lights in the sky that appear and flicker out in more or less the same sequence as the newest video. The credibility of witnesses is suspect when they claim to see Bigfoot or UFOs over and over again, while most people never see them at all.

This brings us to another curiosity: Why is Nerdumb apparently the only person seeing and videotaping these mysterious lights in the sky? For such a high-profile event in such a populated area, it's suspicious that there seem to be no reports or videos taken by anyone else of these UFOs. How does Nerdumb know where in the sky to look, and when to see the extraterrestrial craft? He claims it's not luck ? the aliens communicate with him in his dreams, telling him where to go. If his videos are real, Nerdumb would gain a lot of credibility by publicizing his alien meet-up information so that the public and other UFO researchers could be at the right place and time to see and record it for themselves.
Derek Serra, a Hollywood visual effects artist who analyzed previous UFO videos (including the infamous "Jerusalem UFO" hoax last year), told Life's Little Mysteries that the video was probably faked. "The video looks similar to a photograph, with the lights and helicopter added later as separate elements," Serra said. "The camera controls and hand-held feel would be added later to make it appear as recorded video. The software to do this is readily available, and it doesn't take an expert. The video has many qualities typical of amateur visual effects artists ... it lacks finesse. That finesse may not be obvious to the average viewer, but sticks out like a sore thumb to experienced artists."
Short of a confession from Nerdumb, it's impossible to know for certain whether this video is a hoax, but red flags abound. Maybe it's an ingenious double-deception, and aliens really are here but cleverly disguising their spacecraft to look exactly like faked video images.

Comodo Antivirus 2012
Going online without an antivirus utility to guard your back is just foolish. Even the safest, biggest site can be hacked so that just visiting it earns you an unwanted malware attack. Cost is no excuse, not when there are free choices like Comodo Antivirus 2012. But be warned: Comodo's behavior-based Defense+ module will enlist you as an essential member of the malware-fighting team.
Installation
Comodo Antivirus installed without difficulty on all but one of my 12 malware-infested test systems. The installation process felt rather long, with a required reboot followed by a lengthy antivirus signature update. Immediately on finishing the update, Comodo launched a full scan. That makes sense?the first thing most users want to do is make sure there are no lurking threats.
On the one problem system, Comodo's installation failed with an error message every time due to interference by malware. Installing in Safe Mode didn't work, so I cleaned up the system using Comodo Cleaning Essentials (free, 4.5 stars). After that, the antivirus installed without trouble.
Average Cleanup
At the end of each malware cleanup session, Comodo reported that it had found malware and offered to have a GeekBuddy expert handle the cleanup process. I found this a little misleading, since GeekBuddy service is not free. In each case, I clicked away the offer.
Comodo lists all the malware threats it found, along with the associated file and Registry traces. It assigns each found item a risk level, but marks threats of all levels for removal. In a few cases, it needed a reboot to complete the cleanup.
Comodo detected 85 percent of the threats, just a hair below average. Poor removal of the traces it did find earned it a mediocre malware removal score, 5.4 of 10 possible points. It left behind executable traces for close to half the detected threats, and for nearly half of those at least one process was still running after supposed removal. Comodo left behind all the non-executable traces for many of the rest. AVG Anti-Virus Free 2012 (free, 4 stars), our Editors' Choice for free antivirus, scored 6.5 in this test.
This antivirus proved especially weak against rootkits, detecting 85 percent of them and scoring a low, low 3.9 points, the same as McAfee AntiVirus Plus 2012 ($39.99 direct, 3.5 stars). Comodo Cleaning Essentials removed two rootkits in order to allow installation of Comodo Antivirus. Of those detected by the antivirus alone, all remained running with their rootkit technology still active.
Comodo Antivirus did detect all the scareware samples, but most products manage that feat. Comodo's score of 8.3 for scareware removal is actually low, given that well over half the current competition scored 9.5 or higher. Norton AntiVirus 2012 ($39.99 direct, 4.5 stars) and Malwarebytes' Anti-Malware Free 1.51 (free, 4 stars) aced this test with a perfect 10.

Witness in 'Rockefeller' case found bloodstains (AP)
ALHAMBRA, Calif. ? A forensic scientist testifying Friday in the murder case against a man who posed as an heir to the Rockefeller fortune said she found four bloodstains in the Southern California guesthouse where the suspect lived.
Criminalist Lynne Herold gave the testimony in a preliminary hearing to determine whether Christian Gerhartsreiter should stand trial for the death of John Sohus, whose remains were found at his former home in San Marino in 1994, nearly 10 years after he and his wife vanished.
Herold and her colleagues from the Los Angeles County coroner's office used a chemical reaction at the time to find the stains in the Sohuses' guesthouse, where Gerhartsreiter was a tenant known as Christopher Chichester when the couple disappeared, according to the Los Angeles Times ( http://lat.ms/yLd5Yp).
Herold said three of the four stains showed patterns indicating they had been wiped or something like a body had been dragged through them.
She said she did not take a blood sample because in 1994 such a stain could not be tested for DNA analysis, and it may never be known whose blood it was.
Herold testified that she remembers the investigation despite the passing of so many years, because it was among the most memorable of her career.
"It has from Day One sort of been stuck in my head, and it probably always will be one of those cases that you just never forget," she said.
Many of the witnesses in the preliminary hearing have had difficulty remembering details because so many years have passed.
The couple disappeared in 1985. Gerhartsreiter left town soon afterward.
He is charged only with killing 27-year-old John Sohus; no sign of Linda Sohus has been found.
Gerhartsreiter has previously been exposed as a veteran impostor. On the East Coast, he claimed to be "Clark Rockefeller," a member of the famous family, and married a woman with whom he had a daughter. She divorced him when she found out he had duped her.
Last year, Gerhartsreiter was convicted of kidnapping his daughter in Boston during a custody dispute. He is serving a four- to five-year prison sentence for that crime. He would be eligible for parole this year if he was not facing the California charge, which could bring him 26 years to life in prison if he's convicted.

Patriots in Super Bowl, beat Ravens 23-20 (AP)
FOXBOROUGH, Mass. ? Tom Brady got all the help he needed to get the New England Patriots into the Super Bowl.
Thank you, Billy Cundiff.
The Baltimore Ravens kicker shanked a 32-yard field goal with 11 seconds left and the Patriots escaped with a 23-20 victory in the AFC championship game on Sunday.
Usually, vintage Brady doesn't need much assistance in championship settings, but the Patriots much-maligned defense came through, and Brady's 1-yard touchdown dive with 11:29 left proved to be the winning points.
"Well, I sucked pretty bad today, but our defense saved us," Brady said after throwing for 239 yards, with two interceptions and, for the first time in 36 games, no TD passes. "I'm going to try to go out and do a better job in a couple of weeks, but I'm proud of this team, my teammates."
Brady waited out the final tense minutes on the sideline, and then celebrated with the rest of his team when Cundiff's attempt went wide left. The Ravens looked on in stunned horror.
Cundiff had no excuse.
"It's a kick I've kicked probably a thousand times in my career," Cundiff said. "I went out there and didn't convert. That's the way things go."
Next up as the Patriots chase their fourth Super Bowl trophy in Brady and coach Bill Belichick's tenure in New England is the New York Giants, who beat the San Francisco 49ers 20-17 in overtime Sunday night.
The Patriots were installed as 3-point favorites for the Super Bowl on Feb. 5 in Indianapolis.
In their last trip to the big game, the Patriots had an 18-0 record when they were stunned by the Giants four years ago. They won the NFL championship for the 2001, 2003 and 2004 seasons. This time, they head to the Super Bowl with a 10-game winning streak.
Before Cundiff missed, the Ravens had a chance to go ahead two plays earlier, but wide receiver Lee Evans was stripped of the ball in the end zone by backup cornerback Sterling Moore, who earlier was victimized for a touchdown that gave Baltimore (13-5) the lead 17-16.
On his touchdown, Brady took a huge hit from Ravens star linebacker Ray Lewis, then emphatically spiked the ball as he walked away. Earlier, Brady showed his fire by barking at Lewis following a hard tackle on a 4-yard run.
"It's a pretty mentally tough team," said Brady, whose fifth trip to the Super Bowl will equal John Elway's achievement with Denver. "There's really some resiliency. We've shown that all season. Even in the games we've lost, the three games we lost, we fought until the end. We're always going to fight to the end. It's great to be a part of a team like this."
Baltimore had the touted defense in this matchup, but New England's unit, ranked 31st overall, was just as powerful.
"We stepped up," Pro Bowl nose tackle Vince Wilfork said. "We all stepped up big time. Being in this situation is a great moment. You have to cherish this moment."
The Patriots shut down Ray Rice, the league's total yardage leader, who was limited to 78 yards. Brandon Spikes made a fourth-quarter interception of Joe Flacco, who played well before that and threw for two touchdowns. And when the Ravens were threatening to score a late touchdown to win their first conference title in 11 years, New England clamped down.
"It's two great football teams, two gladiators, I guess, just kind of going at each other at the end, and I'm proud of our guys," Harbaugh said. "You know, we've got 53 guys, mighty men, as we like to call them ? and they fought, and we came up a little bit short, as 53. You know, 53 win and 53 lose."
With Rice a nonfactor, Baltimore had to rely on Flacco, and he delivered one of his best performances. Flacco has led the Ravens into the playoffs in all four of his pro seasons, but not to the Super Bowl. He was 22 for 36 for 306 yards and touchdowns of 6 yards to Dennis Pitta and 29 to rookie Torrey Smith.
The loss hardly could be blamed on Flacco.
"I don't know if I ever will prove anything," he said. "I just play the same way. We lost; someone has to. But we laid it all out on the field."
Operating against a porous secondary missing its top cornerback, Kyle Arrington, who left in the second quarter with an eye injury, Flacco gave Baltimore its first lead. His short pass on third down to explosive receiver Smith turned into a 29-yard scamper down the right sideline after Moore completely whiffed on the tackle.
Danny Woodhead's fumble on the ensuing kickoff set up Baltimore at the Patriots 28, but a third-down sack forced Cundiff to kick a 39-yard field goal, making it 20-16.
New England didn't flinch.
Brady took the Patriots 63 yards in 11 plays, and seemed to score on a 1-yard run. The call was overruled by replay, though, and on fourth-down, he dived just high enough over the line for the winning points.
"Every inch counts in this game and every foot counts in this game," said 12-year veteran guard Brian Waters, who joined the Patriots this year and is headed to his first Super Bowl.
Defense was particularly dominant early on. The Patriots held Baltimore to minus-4 yards on its first three first-down runs and forced the Ravens to go three-and-out each time. Meanwhile, the Patriots put together a methodical 13-play, 50-yard drive helped greatly by an illegal contact penalty on Lardarius Webb that negated a tipped interception by Bernard Pollard.
But Brady was sacked for the first time by Paul Kruger and Stephen Gostkowski kicked a 29-yard field goal.
Late in the first quarter, the Ravens changed tactics after Webb picked off a pass intended for Julian Edelman at the Baltimore 30. Flacco rolled right on first down and threw deep down the sideline to a wide-open Smith. Had the pass not been short, Smith likely would have sprinted into the end zone. Instead, it was a 42-yard gain, not bad at all given Baltimore's previous ineptitude with the ball.
Cundiff's 20-yard field goal momentarily tied it.
Brady, perhaps peeved by his poor throw that Webb picked off, hit two passes for 29 yards on a 75-yard drive to make it 10-3. BenJarvus Green-Ellis rushed for 36 yards on that series, and also drew a personal foul against Webb, who ripped off the running back's helmet on a short rush. Green-Ellis surged into the end zone from the 7, then pointed to the patch on his jersey honoring Myra Kraft, the late wife of Patriots owner Robert Kraft.
In the locker room afterward, Kraft was asked about the motivation the team got from dedicating the season to his wife of 48 years. Kraft tapped an MHK pin on his left lapel and kissed his fingers before pointing upward.
"They're an amazing team, they're a great brotherhood, they're a family," Kraft said.
Going back to the pass, the Ravens tied it on a 6-yard throw to Pitta ? yes, Baltimore has some dangerous tight ends, too ? that concluded an 80-yard march. Flacco opened the drive with a 20-yard completion to Evans and then Anquan Boldin escaped Arrington's attempted tackle to gain 37 more yards on a reception. Flacco was finding holes in New England's coverage, particularly when he moved out of the pocket.
New England's All-Pro tight end Rob Gronkowski made an error at the end of a 63-yard drive, failing to keep two feet in bounds on a catch. Gostkowski's 35-yard field goal made it 13-10.
Gronkowski left for a while with a left leg problem, but soon returned.
"It doesn't even feel right, especially playing with the veterans here," Gronkowski said. "I watched them go to the Super Bowl as I was growing up and now I'm part of it? It is an unreal moment."
Notes: Brady won his 16th career postseason game to tie Joe Montana for most in NFL history. ... New England's seventh Super Bowl appearance puts it one behind Pittsburgh and Dallas. ... Megaupload website charged with piracy (Reuters)
LOS ANGELES (TheWrap.com) ? Federal authorities have charged the owners and operators of the video locker service Megaupload with operating a criminal enterprise that distributes pirated material, the U.S. Justice Department announced on Thursday.
Although the sites they operate advertised that they provide personal storage for users' content, the indictment claims they actually trafficked in hosting television shows and movies -- often offering them to users before their official release.
"Members of the Mega Conspiracy are aware of the way that their sites are actually used by others; have themselves used the systems to upload, as well as reproduce and distribute, infringing copies of copyrighted content; and are aware that they have financially benefited directly from the infringement of copyrighted works that they are in a position to control," the indictment reads.
Kasseem Dean, best known as music producer "Swizz Beatz" and as the husband of Alicia Keys, is not named in the indictment, even though he reportedly serves as Megaupload's chief executive officer.
Megaupload and its sister sites accept online advertising and generate more than $175 million annually, according to a U.S. Justice Department indictment.
The copyright violations are on the order of $500 million in damages, according to the indictment.
The owners and operators of the sites are charged with five counts of copyright infringement and conspiracy. In an announcement, the Justice Department said it ranks "among the largest criminal copyright cases."
It also comes as two bills that would give the Justice Department broader authority to crack down on internet piracy have been hobbled by protests from companies such as Google and Twitter. Tech companies claim the legislation would violate the First Amendment.
Ira Rothken, an attorney for Megaupload, did not immediately respond to requests for comment.
The Megaupload owners each face a maximum penalty of 20 years in prison on the charge of conspiracy to commit racketeering, five years in prison on the charge of conspiracy to commit copyright infringement, 20 years in prison on the charge of conspiracy to commit money laundering and five years in prison on each of the substantive charges of criminal copyright infringement.
The indictment alleges that the criminal enterprise is led by the site's founder Kim Dotcom, also known as Kim Schmitz and Kim Tim Jim Vestor, residents of both Hong Kong and New Zealand.
Also charged are the company's Chief Marketing Officer Finn Batato, a German citizen; graphic designer Julius Bencko, a Slovakian citizen; business development chief Sven Echternach, a German citizen; Chief Technical Officer Mathias Ortmann, a German citizen; software programmer Andrus Nomm, an Estonian citizen; and programmer Bram van der Kolk, aka Bramos, a Dutch citizen.
Dotcom, Batato, Ortmann and van der Kolk were arrested Thursday in Auckland, New Zealand, by local authorities. Bencko, Echternach and Nomm remain at large.

$260 Billion In New Clean Energy Investing In 2011 | EarthTechling

Last late year, when Bloomberg New Energy Finance reported the trillionth dollar was invested in clean energy since it?began counting in 2004, it suggested this was proof ?that the world wasn?t waiting for a climate deal.? Now, with a new Bloomberg report showing the U.S. led a surge in 2011 that brought clean-energy investment to a record $260 billion, sustainable-minded investors are echoing the view ? with some caveats ? according to the advocacy organization Ceres.
According to Bloomberg, investment in the clean energy sector was up 5 percent last year over 2010, and?was almost five times the $53.6 billion recorded in 2004. In fact, in 2011, the U.S. alone beat that 2004 global total,?with investment rising 35 percent to $55.9 billion. Meanwhile, China saw investment rise just 1 percent to $47.4 billion, making the U.S. the world leader for the first time since 2008.

Big investors who gathered for the?Investor Summit on Climate Risk & Energy Solutions at the United Nations took a bow, and vowed to do better.?Ceres said the 450 investors ?controlling tens of trillions from four continents? signed onto a an action plan calling for ?greater private investment in low-carbon technologies and tougher scrutiny of climate risks across their portfolios.? They also announced new guidelines that are aimed at pushing companies to move beyond disclosure and toward action on climate.
?Investors are acutely aware of climate impacts on the global economy and corporate bottom lines,? Jack Ehnes, CEO of the California State Teachers? Retirement System (CalSTRS), the nation?s second largest public pension fund managing $146 billion in assets, said in the Ceres statement. ?As a matter of fiduciary duty, we must elevate our attention and action on this huge issue. That means improving our own practices and making sure companies we own are doing the same.?
